Source text - Ukrainian Однією з основних проблем сучасної судової практики є її непослідовність у питанні розмежування сфер застосування реституції та віндикації нерухомої речі. Перший крок у подоланні цієї проблеми зроблений у результаті прийняття постанови Пленуму Верховного Суду України «Про судову практику розгляду цивільних справ про визнання правочинів недійсними» від 6 листопада 2009 р. № 9. У пункті 10 зазначеної постанови мова йдеться про таке. Реституція як спосіб захисту цивільного права (ч. 1 ст. 216 ЦК України) застосовується лише в разі наявності між сторонами укладеного договору, який є нікчемним чи який визнано недійсним. У зв'язку з цим вимога про повернення майна, переданого на виконання недійсного правочину, за правилами реституції може бути пред’явлена тільки стороні недійсного правочину. Норма ч. 1 ст. 216 ЦК України не може застосовуватись як підстава позову про повернення майна, переданого на виконання недійсного правочину, яке було відчужене третій особі. Не підлягають задоволенню позови власників майна про визнання недійсними наступних правочинів щодо відчуження цього майна, які були вчинені після недійсного правочину. У цьому випадку майно може бути витребуване від особи, яка не є стороною недійсного правочину, шляхом подання віндикаційного позову, зокрема від добросовісного набувача — з підстав, передбачених ч. 1 ст. 388 ЦК України.
Таке обмеження застосування реституції є абсолютно виправданим. Викладене розуміння цивільно-правового закону вказує, по-перше на обмеження кількості правочинів, які можуть бути визнані недійсними, лише першим із них, стороною якого є позивач; по-друге, за правилами реституції не може бути за рішенням суду повернуто майно, передане на виконання недійсного правочину, та яке перебуває не у сторони такого правочину.
Іншим висновком є те, що підставою для визнання наступних правочинів недійсними не може бути лише визнання недійсним першого з ланцюга таких правочинів. Це має змінити поширену нині судову практику, оскільки попередньо суди часто вдавалися до дослідження лише законності першого з оспорюваних правочинів, а висновок про недійсність першого правочину ставав основною підставою для визнання недійсними усіх інших правочинів. Це повністю вихолощує віндикаційний захист права власності, в реалізації якого знайшла своє втілення ідея пошуку компромісу між інтересами власника, який втратив володіння своєї речі, та інтересами цивільного обороту в цілому.
Translation - English One of the main problems of modern court practice is its inconsistency in the issue of distinguishing fields for application of restitution and vindication of a real estate object. The first step to overcome this problem was made as a result of adoption of Decree No. 9 of Plenary Session of Supreme Court of Ukraine “On Court Practice of Reviewing Civil Cases on Determination of Legal Actions as Invalid” of November 6, 2009. Paragraph 10 of the noted decree is dedicated to the following. Restitution as a method for protection of a civil right (part 1 of Article 216 of the Civil Code of Ukraine) is used only in case of concluded contract between parties, which is null and void or recognized as invalid. In this connection, the demand to return property transferred to execute an invalid legal action, can be presented only to a party to invalid legal action, according to restitution rules. The norm from part 1 of Article 216 of the Civil Code of Ukraine cannot be applied as the basis for a claim for property return, which was transferred to execute an invalid legal action and alienated to a third party. The claims of property owners on recognition of the following legal actions, which were executed after the first invalid legal action, as invalid, are not subject to satisfaction. In this case one can require property from a person, which is not a party to the invalid legal action, by submitting a vindication claim, in particular from a bona fide acquirer – on the grounds envisaged by part 1 of Article 388 of the Civil Code of Ukraine.
Such limitation for restitution application is totally justified. The provided understanding of civil law points first of all to the limitation of the number of legal actions which can be deemed invalid; secondly, according to restitution rules, the property transferred for execution of an invalid legal action and remaining in the hands of third party to such legal action cannot be returned as per court decision.
Another conclusion is that the basis for deeming the following legal actions as invalid cannot be only the recognition of the first legal action in the chain as invalid. It has to change the now widespread court practice, as before the courts have often resorted to the investigation of legitimacy of only the first among the disputed legal actions, and the conclusion about invalidity of the first legal action became the main basis for recognition of all the other legal actions as invalid. It fully emasculated vindication protection of an ownership right, the realization of which includes the idea of search for a compromise between the interests of the owner who lost possession of their object and the interests of civil turnover in general.

Source text - English The European Network of Election Monitoring Organizations (ENEMO) fielded 400
short-term observers to monitor the 2007 early parliamentary elections in Ukraine on
September 30, 2007. The short-term observers were coordinated by 25 long-term
observers covering all oblasts of Ukraine. ENEMO observers monitored all stages of the
voting process, including the opening, the vote, the vote count and the tabulation of
results in polling stations and district electoral commissions throughout the country.
ENEMO observers monitored the opening of 195 polling stations, vote procedures in
more then 2000 polling stations and the vote count in 195 polling stations.
SUMMARY OF FINDINGS AND CONCLUSIONS
• ENEMO considers that Ukraine’s 2007 pre-term parliamentary elections were
generally free of pressure, intimidation and harassment against voters, political
parties and blocs and generally met the international standards.
• Due to the intricate legal and constitutional circumstances underpinning the preterm
2007 parliamentary elections, the amended election law was a product of
political compromise adopted once more only shortly before election which had a
negative impact over the electoral process.
• ENEMO assess the recent amendments to the election law, especially concerning
the special border crossing lists and the abolishment of absentee ballots, as a step
back compared to the previous elections since they had a disenfranchising effect
on specific groups of electorate
• The Central Election Commission (CEC) worked in a relatively transparent
manner, but some of its decisions reflected the partisan political affiliations of its
members and negatively impacted the electoral process. With regard to the work

of the Precinct Election Commissions (PECs) ENEMO observers noted progress
compared to 2006 elections.
• ENEMO remains concerned about serious flaws in the voter registration process.
In particular, double entries in the voter lists had created space for possible
multiple voting and ballot stuffing.
• The process of border crossing registration of voters was significantly delayed
and unevenly enforced, thus ENEMO signaled the possibility of abuses.
Moreover, ENEMO considers that the provision itself unjustly disenfranchised a
significant number of voters;
• ENEMO feared that delays in setting clear procedures for homebound mobile
voting negatively influenced the preparation and organization of electoral process.
• Compared to 2006 parliamentary elections, ENEMO observers reported slight
increase of cases of involvement of state and local officials in the campaign and
usage of local administrative resources for campaign purposes.
• Delays in the formation of precinct election commissions (PEC) have raised
serious concern about the ability of these commissions to fulfill their duties and
operate optimally in the electoral process.
• Mass media enabled the electorate to familiarize itself with the programs of
competing political parties via extensive coverage of the election campaign in
news programs, television debates, and paid advertisements.
• The campaign period for the 2007 early parliamentary elections was competitive
and generally free of intimidation, pressure, and harassment.
• The role of courts in adjudication electoral disputes in the pre-election period and
during election campaign was very important and in most cases courts were
taking decisions in a timely manner. However, pending decision of the
Constitutional Court to rule on the constitutionality of the border guard provision
triggered doubts over the legality of the whole process.
• Significant drawbacks were registered during the filling of PEC protocols and the
tabulation of results causing significant delays in announcing the final official
results by the CEC (only as of October 15, the last day of the legal deadline).
Translation - Ukrainian Європейська мережа організацій, що спостерігають за виборами (ЕНЕМО), направила 400 короткострокових спостерігачів для моніторингу дострокових парламентських виборів в Україні 30 вересня 2007 р. Короткострокові спостерігачі координувалися 25 довгостроковими спостерігачами в усіх регіонах України. Спостерігачі ЕНЕМО провели моніторинг усіх етапів виборчого процесу, включаючи відкриття виборчих дільниць, голосування, підрахунок голосів та зведення результатів на виборчих дільницях та в окружних виборчих комісіях по всій країні. Спостерігачі ЕНЕМО споглядали за відкриттям 195 виборчих дільниць, процедурами голосування на більш ніж 2000 виборчих дільницях та підрахунком голосів на 195 виборчих дільницях.
ОСНОВНІ ФАКТИ ТА ВИСНОВКИ
• ЕНЕМО вважає, що дострокові вибори в Україні 2007 року були загалом вільні від тиску, залякування та погроз по відношенню до виборців, політичних партій та блоків і загалом відповідали міжнародним стандартам.
• Заплутана законодавча та конституційна ситуація під час дострокових парламентських виборів 2007 року пояснюється зміненим законом про вибори, який був наслідком політичного компромісу і знову був прийнятий напередодні виборів, що негативно вплинуло на виборчий процес.
• ЕНЕМО оцінило нещодавні зміни у виборчому законодавстві, особливо ті, що стосувалися спеціальних списків від’їжджаючих за кордон та скасування відкріпних талонів, як крок у зворотньому напрямку порівняно з попередніми виборами, оскільки ці зміни несправедливо позбавили певні групи електорату права голосу.
• Центральна виборча комісія (ЦВК) працювала у досить прозорому режимі, однак деякі її рішення відображали партійну приналежність її членів та негативно впливали на виборчий процес. Щодо роботи дільничних виборчих комісій (ДВК), спостерігачі ЕНЕМО відзначили прогрес порівняно з виборами 2006 року.
• ЕНЕМО знову висловлює своє занепокоєння серйозними недоліками процесу реєстрації виборців. Зокрема, це подвійні записи у списках виборців, що створили можливість для багаторазового голосування та виборчих фальсифікацій.
• Процес реєстрації виборців під час перетину ними кордону був значно затриманий та застосовувався нерівномірно, тому ЕНЕМО заявила про можливість зловживань. Більше того, ЕНЕМО вважає, що саме положення несправедливо позбавило права голосу значну кількість виборців.
• ЕНЕМО висловлювала своє занепокоєння тим, що затримки у визначенні чітких процедур голосування вдома негативно вплинули на підготовку та організацію виборчого процесу.
• Порівняно з парламентськими виборами 2006 року, спостерігачі ЕНЕМО звітували про незначне збільшення випадків залучення державних та місцевих посадовців у передвиборчу кампанію та використання місцевих адміністративних ресурсів для її проведення.
• Затримки з формуванням дільничних виборчих комісій (ДВК) викликали серйозне занепокоєння щодо здатності цих комісій виконувати свої обов’язки та оптимально функціонувати під час виборчого процесу.
• Засоби масової інформації надали можливість електорату ознайомитися з програмами конкуруючих політичних партій за допомогою широкого висвітлення передвиборчої кампанії у новинах, телевізійних дебатах та політичній рекламі.
• Період кампанії перед достроковими парламентськими виборами 2007 року був конкурентним та загалом позбавленим від залякування, тиску та погроз.
• Роль судів у вирішенні виборчих суперечок протягом передвиборного періоду та кампані була дуже важливою і в більшості випадків суди виносили рішення вчасно. Однак затягування рішення Конституційного Суду щодо конституційності положення про реєстрацію виборців, які вибувають за кордон, поставила під сумнів легітимність усього виборчого процесу.
• Спостерігачі зазначили наявність великої кількості помилок протягом заповнення протоколів у ДВК та зведення результатів, що призвело до значних затримок в оголошенні остаточних офіційних результатів ЦВК (лише 15 жовтня, в останній день терміну, визначеного законом).
