sempre in un contratto di compravendita si parla di costituire una servitù gratuita di uso pubblico - a senso tradurrei con voluntary easement - ma sinceramente non ne sono per nulla sicura.

Se vogliamo individuare un termine generico che si adatti a più tipi di servitù, direi che questo è quello più generale. Poi diversi tipi di servitù prendono diversi nomi e si traducono in modo di volta in volta diverso.

Secondo me si riferisce a public use.
Anyone has the right to use it.
Easements by definition are provileges without profits.
